These Terms & Conditions ("Terms") govern your access to and use of knightmarineparts.com (the "Site") and your purchase of products from Knights Marine Parts ("Knights Marine Parts," "we," "us," or "our"). By placing an order or otherwise using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to place an order with us. By ordering, you represent that you are purchasing for your own use or for use within your organization, and not for unauthorized resale.
2. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, legal requirements, or for other reasons. Changes take effect once posted to this page, and the "Last updated" date above will be revised accordingly. Changes apply to orders placed after the update; they do not retroactively apply to orders already confirmed.
3. Products and Product Information
We sell marine and personal watercraft (PWC) parts across a wide range of engine brands, including Yamaha, Mercury/Mercruiser, Suzuki, Honda, Johnson/Evinrude, Tohatsu/Nissan, Chrysler/Force, Volvo Penta, Sea-Doo, Kawasaki, Polaris, Tigershark, and Crusader. We make reasonable efforts to display accurate product descriptions, cross-reference numbers, fitment information, images, and pricing, but errors can occur. We do not warrant that product descriptions, cross-reference numbers, or other content on the Site are error-free, complete, or current, and we reserve the right to correct any errors and to update, change, or remove information at any time without prior notice.
Each product listing indicates whether the part is OEM (Original Equipment Manufacturer) or Aftermarket. Fitment information and cross-reference numbers are provided as a guide to help you identify the correct part; you are responsible for verifying that a part is correct for your specific engine model, model year, and configuration before ordering, including by consulting your engine's serial number, owner's manual, or a qualified marine mechanic where fitment is uncertain.
4. Ordering
An order you place through the Site is an offer to purchase. We may accept or decline any order at our discretion, including in cases of suspected fraud, pricing or listing errors, unavailable inventory, or issues with payment. A contract for sale is formed only when we confirm your order, typically by email. If we cannot fulfill part or all of an order after payment has been taken, we will notify you and issue a refund for the affected item(s).
5. Pricing and Payment
All prices are listed in U.S. dollars and are subject to change without notice, though changes will not affect orders already confirmed. Prices displayed at checkout may not include applicable sales tax or shipping charges, which will be calculated and disclosed before you complete your purchase. Payment is due in full at the time of order. By submitting payment information, you represent that you are authorized to use the payment method provided.
6. Shipping and Delivery
Shipping methods, carriers, and estimated delivery windows are provided at checkout. Delivery dates are estimates only and are not guaranteed; we are not responsible for carrier delays outside our control. Risk of loss and title to products pass to you upon our delivery of the product to the carrier, unless otherwise required by law.
7. Inspecting Your Order
Please inspect your order promptly upon delivery. If an item arrives damaged, incorrect, or missing, contact us at knightsmarine@yahoo.com within 5 days of delivery so we can make it right. Claims reported after this window may still be reviewed at our discretion but cannot be guaranteed the same resolution.
8. Installation and Use
Marine engine parts are mechanical and electrical components whose proper installation directly affects the safe operation of your vessel. You are responsible for ensuring that any part is installed correctly, by a qualified individual, and in accordance with the applicable engine manufacturer's specifications and service manual. We are not responsible for damage, injury, or engine failure resulting from incorrect installation, incompatible use, modification of a part, or failure to follow manufacturer installation and maintenance guidance.
9. Warranties
Where a product carries a manufacturer's warranty, that warranty is provided by the part's manufacturer and is subject to its own terms, which we will pass along to you where available. Except for such manufacturer warranties and any warranties that cannot be excluded under applicable law, products are sold "as is" and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Nothing in this section limits any non-waivable statutory rights available to consumers under applicable law.
10. Returns
We accept returns of unused, uninstalled products in their original condition and packaging within 30 days of delivery, with no restocking fee. To start a return, contact us at knightsmarine@yahoo.com with your order number. Once we receive and inspect the returned item, we will issue a refund to your original payment method. Special-order items, electrical components that show signs of installation or use, and items damaged after delivery due to improper handling or installation are not eligible for return. Shipping charges are non-refundable, and return shipping costs are the customer's responsibility unless the return is the result of our error (wrong item shipped, defective on arrival, etc.), in which case we will cover return shipping.
11. Events Outside Our Control
We are not liable for any failure or delay in performing our obligations where the failure or delay results from events beyond our reasonable control, including natural disasters, carrier disruptions, labor disputes, supplier shortages, or other similar events.
12. Limitation of Liability
To the fullest extent permitted by law, Knights Marine Parts' total liability arising out of or relating to your order or use of the Site is limited to the amount you paid for the product(s) giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of use of your vessel, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnification
You agree to indemnify and hold Knights Marine Parts harmless from any claims, losses, damages, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of a product, or your violation of any law or the rights of a third party.
14. Intellectual Property
All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Knights Marine Parts and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our prior written consent. Manufacturer names, brand names, and part numbers referenced on the Site are used for identification and cross-reference purposes only; we are an independent retailer and are not affiliated with, sponsored by, or endorsed by the engine manufacturers whose parts we sell unless expressly stated.
15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, and without application of the United Nations Convention on Contracts for the International Sale of Goods.
16. Disputes
If a dispute arises, please contact us first at knightsmarine@yahoo.com so we can try to resolve it informally. If we're unable to resolve a dispute informally, it may be brought in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
17. Privacy
Our collection and use of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
18. General Terms
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Knights Marine Parts regarding your use of the Site.
